By downloading, installing, accessing, or using the TellNotes application ("App", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

TellNotes is a mobile application that provides:

• Voice recording and transcription services
• Audio and video file processing and transcription
• Usage limit tracking and subscription management (stored in Apple's iCloud Key-Value Storage)
• AI-powered text summarization and title generation using Grok AI
• Cloud synchronization of notes and transcriptions using Apple CloudKit and iCloud
• Usage limits and subscription data synchronization via Apple's iCloud Key-Value Storage
• Share extension functionality for importing media from other applications
• Integration with Apple Sign-In for authentication
• File sharing and document management
• Background audio processing
• Live Activities and notifications

3. User Accounts and Authentication

3.1 Account Creation

• You may use the App anonymously or create an account using Apple Sign-In
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information when creating an account

3.2 Account Security

• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. User Content and Data

4.1 Your Content

• You retain ownership of all content you create, upload, or share through the Service
• This includes voice recordings, transcriptions, notes, and imported media files
• You grant us a limited license to process, store, and sync your content as necessary to provide the Service

4.2 Content Restrictions

You agree not to use the Service to:

• Record, upload, or share content that is illegal, harmful, threatening, abusive, defamatory, or invasive of privacy
• Violate any intellectual property rights
• Share content containing malware or harmful code
• Engage in any activity that could harm minors
• Violate any applicable laws or regulations

4.3 Content Processing

• The App processes audio and video files to extract audio and generate transcriptions
• We use two transcription methods: local processing with WhisperKit (whisper-small model) and cloud processing through lemonfox services with advanced WhisperAI models
• Apple's Speech Recognition framework is used solely for user interface text display and speech-to-text input in search fields and text editing areas within the app
• AI text processing (summarization, title generation, text transformation) is performed using Grok AI services
• Cloud synchronization uses Apple CloudKit for note data and iCloud for audio files
• Processing may occur both on-device and through cloud services

5. Privacy and Data Protection

5.1 Data Collection

By using our Service, you acknowledge and agree to our Privacy Policy, which details:

• What personal information we collect
• How we use, store, and protect your information
• Your rights regarding your personal data
• Third-party integrations and data sharing
• Cloud synchronization through Apple CloudKit and iCloud services

5.2 Microphone and Media Access

• The App requires microphone access for voice recording functionality
• The App may access your media library when you choose to import files
• When cloud sync is enabled, note data is stored in Apple CloudKit and audio files in iCloud
• You can control these permissions through your device settings

6. Intellectual Property Rights

• TellNotes and all related trademarks, logos, and intellectual property are owned by us
• The App's source code, design, and functionality are protected by copyright and other intellectual property laws

6.2 Your Rights

• You retain all rights to your original content created through the Service
• You may export your data at any time through the App's export functionality

7. Third-Party Integrations

7.2 Grok AI Services

• The App uses Grok AI for AI-powered text processing features
• This includes text summarization, automatic title generation, and text transformation
• Use of Grok AI is subject to xAI's Terms of Service and Privacy Policy
• We are not responsible for xAI's services or policies

7.3 lemonfox Cloud Services

• The App may use lemonfox cloud transcription services for advanced audio processing
• Cloud transcription uses advanced WhisperAI models for improved accuracy
• Use of lemonfox services is subject to their Terms of Service and Privacy Policy
• We are not responsible for lemonfox's services or policies

7.4 WhisperKit Local Processing

• The App uses WhisperKit library for local audio transcription
• Local processing uses whisper-small model for on-device transcription
• Local processing protects your privacy by keeping audio on your device

8. Subscription and Payment Terms

8.3 Subscription Services

• Subscription fees are charged through the Apple App Store
• Subscriptions automatically renew unless cancelled
• You can manage your subscription through your Apple ID account settings
• Subscription features are activated immediately upon successful payment

8.4 Refunds

• All purchases are subject to Apple's refund policy
• We do not process refunds directly
• Contact Apple Support for refund requests

9. User Conduct and Fair Use

9.1 General Conduct

You agree to:

• Use the Service only for lawful purposes
• Respect the privacy rights of others when recording
• Comply with all applicable laws regarding recording and data protection
• Not attempt to reverse engineer or hack the Service
• Not share account credentials with others

• You may stop using the Service at any time
• You may delete your account through the App settings
• You can choose between different data deletion options

12. International Users

• The Service is operated from Republic of Kazakhstan
• By using the Service, you consent to the transfer of your data to Republic of Kazakhstan
• You are responsible for compliance with local laws in your jurisdiction

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the Republic of Kazakhstan. Any disputes shall be resolved in the courts of Astana, Kazakhstan.

13.2 Dispute Resolution

• Any disputes will be resolved through binding arbitration where permitted by law
• You may opt out of arbitration by contacting us within 30 days of first use

15. Changes to Terms
